NUDISM IN SPAIN. legislation

In times of Franco nudity was banned in Spain and remained so until the current wording of the Spanish constitution, and until 1989 when was abolished the law which punished the Public Scandal (by violating the moral). So although many people (including cops accused of public scandal, that crime no longer exists).

The Spanish constitution says:

In its article 16 gives the right to non-discrimination for ideas or personal circumstances. (can be extrapolated to nudity).


In its article 18 gives the right to own image. Right to clothing (or lack thereof).

In its Article 19 gives the Freedom of Movement throughout the national territory, without restrictions (so that you can not limit access of the nudists, or include them in ghetto areas)

In its Article 20 gives the right to free expression (and nudity can be a form of expression).

In its Article 27 guarantees freedom of education. All education is respected regardless of morality, while not against the law.


The constitution also determines that there should be equality between different moralities and none can prevail over others.

Also everything is considered legal if its no regulated by law. (And none law prohibits direct or indirect the nudism, or regulating their practice).

The only law that was abolished in 1989 forbade the public scandal.

Another law misapplied against nudists is that of the Exhibition and Sexual Provocation, which can only be applied if you have Mentally Handicapped or Children in front and there is sexual intent to provoke others or yourself.


Local regulations can only based on laws (and there is no nudity on). Therefore any municipal law restricting nudity is illegal.

Yet it is always recommended unless if you are in an organized group or you are in a remote area, not argue too much with the police, and that can take you withheld for disobediencebut later a judge will give you the reason.


UNICEF, the international maximum organism for the defense of the child, does not consider the view of human nudity, between any of the harm to children in any of its documents.

In Valencia there are two Naturist Associations (at least that I have found), one in Puerto de Sagunto and the other in Valencia capital.
